Arbitrariness is the practice of making decisions without clear criteria or rationale. When an employee is terminated even though they are performing at the same level or better than others who are not terminated, this is an arbitrary decision.


Causes of Arbitrariness

  • Lack of clear policies and procedures
  • Poor communication
  • Personal biases and prejudices

There are many reasons why a company might make an arbitrary termination decision.

For example: A manager may have a personal bias against the employee, or the company may need to reduce its workforce. Regardless of the reason, arbitrary termination is unfair.


You should be given a Warning Letter or PIP Program before termination! Termination without process is unfair and questionable.

If you are terminated arbitrarily, consult an employment lawyer to explore your legal rights.
